Welcome to Faby (hereinafter referred to as the "App"). By downloading, accessing, or using the App, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.
These Terms constitute a legal agreement between ("Company", "We", "Us") and the User ("You").
1. DESCRIPTION OF SERVICES
Faby is an AI-powered mobile application designed to generate personalized stories and fairy tales based on user-defined parameters (e.g., story style, drawing style, age group, moral of the story). The App provides additional features to enhance user experience, including but not limited to:
- AI-generated text and illustrations.
- Text-to-Speech (audio reading) functionality.
- Child-friendly dictionary and vocabulary tools.
- Interactive puzzles and mini-games.
- In-app drawing tools.
- A gamified library system allowing users to collect books and decorate their virtual library with digital items.
2. ELIGIBILITY AND PARENTAL SUPERVISION
- Age Requirement: While Faby provides content for children, the App is intended to be set up and managed by an adult. By creating an account or making a purchase, you represent that you are 18 years of age or older (or the age of legal majority in your jurisdiction).
- Parental Responsibility: If you are a parent or legal guardian permitting a minor to use the App, you agree to be bound by these Terms on behalf of yourself and the minor. You are responsible for supervising the child’s use of the App and ensuring the suitability of the AI-generated content for your child.
3. ARTIFICIAL INTELLIGENCE (AI) CONTENT
- Nature of AI: Faby utilizes advanced Artificial Intelligence to generate stories and images. You acknowledge that AI may occasionally produce content that is unpredictable, inaccurate, or nonsensical.
- Content Safety: We employ strict safety filters to prevent the generation of inappropriate, harmful, or unsafe content for children. However, given the evolving nature of AI, we cannot guarantee 100% filtration accuracy.
- Reporting: If you encounter any content that you deem inappropriate, you must use the in-app "Report" feature or contact us immediately so we can adjust our filters.
- Uniqueness: AI-generated content is created based on patterns. We do not guarantee that the stories or images generated for you will be unique or exclusive.
4. USER CONDUCT AND GENERATED CONTENT
- Prohibited Prompts: You agree not to use the App to generate content that is violent, sexually explicit, hateful, harassing, or illegal. We reserve the right to suspend accounts that attempt to bypass our safety protocols.
- User Creations: Any drawings created by you or your child using the in-app "Drawing Tool" remain your property. However, by saving them in the App, you grant the Company a license to display and store these images within the scope of providing the Service.
5. SUBSCRIPTIONS AND PAYMENTS
- Paid Features: Certain features of Faby (e.g., unlimited story generation, premium library decorations, exclusive art styles) may require a paid subscription or a one-time purchase.
- Billing: Payments are processed through the applicable app store (Apple App Store or Google Play Store).
- Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
- Refunds: Refunds are subject to the policies of the Apple App Store or Google Play Store. Generally, digital goods are non-refundable once accessed.
6. VIRTUAL ITEMS AND REWARDS
- The App allows users to earn or purchase virtual items (e.g., "Library Ornaments," "Book Skins").
- These items are purely digital, have no real-world monetary value, and cannot be exchanged for cash or transferred to other users.
- We reserve the right to modify or remove virtual items at any time without liability.
7. INTELLECTUAL PROPERTY
- Ownership: The App, including its source code, design, logos, "Faby" trademark, and underlying technology, is the exclusive property of the Company.
- License: We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
8. DISCLAIMER OF WARRANTIES
The App is provided on an "AS IS" and "AS AVAILABLE" basis. The Company makes no warranties regarding the accuracy of the AI-generated educational content, the "Child-Friendly Dictionary," or the moral lessons within the stories. The App is for entertainment purposes and is not a substitute for professional education or advice.
9. LIMITATION OF LIABILITY
To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, or consequential damages arising out of your use or inability to use the App, including any errors in AI-generated content.
10. CHANGES TO TERMS
We reserve the right to modify these Terms at any time. Significant changes will be notified via the App or email. Continued use of the App after such changes constitutes acceptance of the new Terms.
