1. Parties

The Service is provided by Yelkovan.ai (Yiğit Özdemir) ("we", "us"). Email: info@yelkovan.ai. In these terms, "you" means the adult who creates and uses the Faby account.

2. The Service

Faby is an app that creates personalised children's stories with artificial intelligence based on the details you enter. The Service mainly includes:

• AI-generated story texts and illustrations,
• Narration of stories (optionally in a voice created from an adult's own voice),
• A free classic-tales section,
• Activities such as the Drawing Atelier, puzzles, a bookshelf and decorations,
• Limited social features such as friend codes, gifting stories, emoji reactions and a read-together room (there is no free-text chat between users).

We may change, improve or remove features of the Service over time.

3. Eligibility and parental responsibility

• The account holder is an adult. You must be over 18 (or the age of majority in your country) to create an account, make purchases and manage settings.
• Supervision. If you let your child use Faby, you accept these terms on behalf of yourself and your child. You are responsible for supervising your child's use and for judging whether the stories created are suitable for your child.
• What you enter. You are responsible for the details you enter for the child profile and story inputs. Do not enter other people's personal information without the necessary permission.
• Parental gate. Purchases, settings, external links and sharing are protected by a simple adult check (currently for some age groups; for all age groups from the next version). This check is only a supporting measure; protecting your device and store account (e.g. a purchase password) is your responsibility.

4. Accounts and guest use

• Accounts are created by signing in with Google, Apple or email and password. You are responsible for the security of your account and for activity under it.
• You can create 1 free story as a guest without an account. Guest stories are deleted automatically after 7 days.
• How your personal data is processed is explained in the Privacy Policy.

5. AI-generated content

• Automatic generation. Stories, illustrations and narration are generated automatically by AI models.
• Safeguards and their limits. We use automated safeguards that add child-safety instructions to AI requests and sanitise image prompts. However, stories are not each reviewed by a person and automated safeguards are not perfect. AI output can occasionally be inaccurate, inconsistent or inappropriate. We recommend looking through stories before sharing them with your child.
• Informational nature. Stories are for entertainment and are not a substitute for educational, medical, psychological or other professional advice. Information or dictionary explanations in stories may be wrong.
• Uniqueness. We do not guarantee that generated stories or images will be unique; similar content may be generated for other users.

6. Reporting inappropriate content

If you come across inappropriate, harmful or incorrect content, please send the story title, the date and, if possible, a screenshot to info@yelkovan.ai. An in-app "Report" option will be added in the next version; until then, reports are taken by email. For child-safety reports, see our Child Safety Standards.

7. Acceptable use

When using Faby, you agree not to:

• try to generate violent, sexual, hateful, harassing, illegal or otherwise harmful content for children,
• try to bypass safeguards or steer the AI to do so,
• upload or enter other people's photos, voices or personal information without permission, and in particular clone another person's voice without their explicit permission,
• use the social features to disturb, mislead or exploit others,
• reverse engineer, copy, overload with automated tools, or attempt unauthorised access to the app,
• resell or distribute the Service or generated content for commercial purposes.

If these rules are broken, we may remove content and suspend or close the account. We have zero tolerance for child sexual abuse content and report it to the competent authorities in line with our legal obligations.

8. Your content and generated stories

• You keep your rights in the drawings, photos and voice recordings you upload and the inputs you write. You allow us to use them only to provide the Service (to store, process and show them to you and to send them to the service providers listed in the Privacy Policy).
• You may use the stories generated for you within the Service for personal, non-commercial purposes.
• You confirm that you have the necessary rights and permissions for the content you upload.

9. Faby Pro, coins and payments

• Faby Pro. Faby Pro is offered as monthly and yearly subscriptions. An active Faby Pro subscription lets you create 7 new stories per week. What the subscription includes is shown in the app and in the store before you buy.
• Coins. You can buy coin packs or earn coins through in-app activities. Coins are spent to create stories: 100 coins for a standard story, 150 coins for an interactive story. Coins are virtual items; they have no monetary value, cannot be exchanged for cash, and unused coins are lost when your account is deleted.
• Payment. All purchases are made through the Apple App Store or Google Play using the payment method linked to your store account. Purchases are managed through RevenueCat. Prices are shown in the store, in your local currency, before you buy.
• Auto-renewal. Subscriptions renew automatically for the same period at the price shown in the store unless cancelled at least 24 hours before the end of the current period. Under the store's rules, the renewal may be charged within the 24 hours before the period ends. If the store offers a free trial and you do not cancel before it ends, the paid subscription starts.
• Managing and cancelling. You can manage and cancel your subscription in your App Store or Google Play account settings. Deleting the app or your Faby account does not cancel the subscription. Cancellation takes effect at the end of the current period.
• Refunds. Refunds are requested through the relevant store under Apple's or Google's policies. Your mandatory consumer rights are not affected.
• Apple users. Purchases made on iOS and use of the app on iOS devices are also governed by Apple's Standard End User License Agreement (EULA), in addition to these terms. Apple is not a party to these terms and has no obligation to provide support or maintenance for the Service.

10. Advertising

The Android app shows Google AdMob ads in the free classic-tales section (a banner on the reading screen and a short video ad when opening some classic tales). Ads are flagged as child-directed, limited to a maximum content rating of "G" and not personalised. There are no ads in iOS 5.3.0 and later. See the Privacy Policy for details.

11. Social features

Friends are added with a friend code; nicknames are chosen from fixed word lists and there is no free-text messaging between users. Gifted stories may contain the character name you typed. We recommend sharing your friend code only with people you know.

12. Intellectual property

The app, its design, the "Faby" name and logo, the adaptations in the classic-tales library and the software belong to us or our licensors. We grant you a limited, non-exclusive, non-transferable and revocable licence to use the Service for personal, non-commercial purposes.

13. Termination

• You can delete your account at any time in the app (Profile → Account Actions → Delete Account) or follow the steps on the Delete Your Account page.
• We may suspend or close your account if you breach these terms, if required by law or if the security of the Service requires it. Where possible, we will tell you in advance.
• When an account is closed, your data is deleted as described in the Privacy Policy. You need to cancel your store subscription separately.

14. Disclaimer and limitation of liability

The Service is provided "as is" and "as available". To the extent permitted by applicable law, we do not guarantee that the Service will be uninterrupted or error-free, or that AI output will be accurate or always appropriate. To the extent permitted by applicable law, we are not liable for indirect, incidental or consequential damages. This section does not affect consumer rights that cannot be limited by contract.

15. Changes

We may update these terms. The current version is published on this page and the date at the top changes. We will announce important changes in the app or on our website. Continuing to use the Service after a change means you accept the updated terms.

16. Governing law and jurisdiction

These terms are governed by the laws of the Republic of Türkiye, and the courts and enforcement offices of Istanbul have jurisdiction over disputes. This does not remove the rights you have under the mandatory consumer protection rules of the country where you live.
